The proposal by Democratic Congressman Shri Thanedar to completely abolish the Immigration and Customs Enforcement agency (ICE) is reckless and dangerous. Thanedar argues that ICE is “beyond any reform” and “totally out of control,” calling for the agency’s elimination following an isolated incident in Minneapolis. However, this extreme measure ignores the essential role ICE plays in U.S. border security and the enforcement of the rule of law.
ICE was created in 2003 precisely to consolidate immigration enforcement functions that had previously been handled in a fragmented manner, building operational expertise that cannot be easily replaced. Its elimination, as proposed in the Abolish ICE Act, would not only dismantle the agency as it exists today—an action that would constitutionally require majority support in both Congress and the Senate—but would also jeopardize the country’s ability to enforce its own immigration laws and combat transnational criminal networks.
Moreover, abolishing an entire agency in response to an individual tragedy risks politicizing isolated events and weakening public institutions. Even within the Democratic Party itself, this approach has generated tension, with centrist leaders warning that a campaign to eliminate ICE could trigger electoral backlash and alienate moderate voters who favor responsible reforms rather than radical solutions.
Furthermore, proposals that completely eliminate an institution without a legitimate and viable plan to replace its critical functions—such as border oversight, the detention of foreign criminals with deportation orders, and the fight against human trafficking organizations—create a public policy vacuum that could be exploited by those seeking to enter the country illegally or evade the law. Any realistic reform must balance the protection of human rights with the need to maintain national security and the integrity of the immigration system. Eliminating an entire federal agency outright is not only impractical, but also irresponsible from the standpoint of security and institutional stability.
